DISCLOSURE REGARDING THE PROCESSING OF PERSONAL DATA
The Company BIOTEX S.R.L., with registered office located at VIA LEONARDO DA VINCI 16, FAENZA (RA), in its capacity as Data Controller of personal data pursuant to art. 4 of EU Regulation 2016/679, hereby informs you, pursuant to art. 13 of the above-mentioned Regulation, that it will process your personal data manually and/or electronically for the purposes indicated below.
Purposes of the processing, legal basis, and possible third-party recipients of the data
Your personal data will be processed for purposes related to the management of ordinary business relations and, specifically, for the compilation of master lists, customer/supplier accounting, invoicing, and paper-based and electronic communications.
Your data may be processed for internal statistical and market research purposes.
Your data may also be disclosed to third parties, for technical and operational requirements strictly related to the purposes set out above, and in particular to the following categories of parties:
a) bodies, professionals, companies, or other organisations commissioned by us to process data in connection with the fulfilment of administrative, accounting, and management obligations associated with the ordinary running of our business, also for debt collection purposes;
b) public authorities and administrations for purposes related to the fulfilment of legal obligations;
c) banks, financial institutions, or other entities to which the transfer of the aforementioned data is necessary in order to carry out the activities of our company in relation to the fulfilment by us of our contractual obligations to you;
d) suppliers of services of installation, support, and maintenance of computer and telematic systems and equipment and of all the services functionally connected and necessary for the performance of the services covered by the Contract.
Failure to provide personal data will make it impossible for us to execute contracts or fulfil other related obligations, as well as to properly manage our mutual business relations.

Legal basis
Your personal data will be processed for the performance of a contract entered into with you or for the implementation of pre-contractual measures adopted at your request.

Data retention period
Your personal data will be retained for the amount of time strictly necessary to achieve the purposes described above and to comply with legal obligations.
Rights of the data subject
Pursuant to Articles 13(2) and 15-21 of EU Regulation 2016/679, we hereby inform you that you may exercise the following rights with regard to the processing of your personal data:
a) The right to obtain access to your personal data and the following information:
• confirmation as to whether or not your personal data is being processed;
• the purposes of the processing;
• the categories of personal data;
• the recipients or categories of recipient to whom the personal data have been or will be disclosed;
• where the personal data are not collected from the data subject, any available information as to their source;
• the existence of an automated decision-making process, including profiling;
• a copy of the personal data being processed.
b) The right to rectification and completion of personal data;
c) The right to the erasure of personal data ("right to be forgotten") if any of the following reasons applies:
1. the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
2. the data subject withdraws consent to the processing of the data and there is no other legal basis for the processing;
3. the data subject objects to the processing and there is no overriding legitimate ground for the processing;
4. the personal data have been unlawfully processed;
5. the personal data must be erased in order to comply with a legal obligation under EU or Member State law to which the data controller is subject;
Where the data controller has made personal data public and is obliged to erase them, the data controller must inform the other data controllers that are processing the personal data of the request to erase any links, copies, or reproductions of such personal data.
d) The right to the restriction of processing, if:
1. the accuracy of the personal data is disputed by the data subject, for as long as it takes for the data controller to check the accuracy of the personal data;
2. the processing is unlawful and the data subject objects to the erasure of the personal data and requests instead that their use be restricted;
3. although the data controller no longer needs the personal data for processing purposes, the personal data are needed by the data subject for the establishment, exercise, or defence of legal claims;
4. the data subject has objected to the processing, pending verification as to whether the legitimate reasons of the data controller override those of the data subject.
e) The right to lodge a complaint with the Italian Data Protection Authority, following the procedures and instructions published on the Authority's official website www.garanteprivacy.it.
f) The right to data portability, i.e. the right to receive the personal data concerning him or her that he or she has provided to a data controller, in a structured, commonly used, and machine-readable format and, where applicable, to have them transmitted to another data controller, where the processing is based on consent or on a contract and is carried out by automated means. If technically possible, the data subject shall have the right to obtain the direct transmission of personal data from one data controller to another.
g) The right to object at any time to the processing of personal data, including profiling, in particular where:
1. the processing is carried out on the basis of the legitimate interest of the data controller, subject to an explanation of the reasons for the objection;
2. the personal data are processed for direct marketing purposes.
h) The right not to be subject to a decision based solely on automated processing, including profiling, except where the decision: is necessary for the conclusion or performance of a contract between the data subject and a data controller; is authorised by EU or Member State law to which the data controller is subject; or is based on the data subject's explicit consent.
i) The right to withdraw consent at any time.
Exercising your rights is not subject to any formal constraint and is free of charge.
